Debt collection is matter of primary importance for individuals and businesses alike and while amicable out of court settlement is favoured from a cost and time perspective, the filing of contentious proceedings is at times required.
This seminar aims to provide an in depth understanding of the debt collection tools which are available to the creditor and which serve to increase the creditor’s effective chances of recovery such as judicial letters, precautionary acts, summary proceedings, executive titles and enforcement through executive acts. An overview of when and how contentious proceedings are to be filed in the Small Claims Tribunal, Court of Magistrates or First Hall Civil Court and the differing procedural norms which are applicable to these Courts and Tribunal will be provided.
Attendees will also be provided with a better understanding of some of the general defensive pleas which are available to the debtor.
The Speaker
Dr Kirk Brincau graduated from the University of Malta with a Doctor of Laws in 2016 and is a senior associate at Mamo TCV Advocates. He currently works in the firm’s litigation and employment law departments and regularly represents clients in inferior courts, boards, tribunals and the superior courts of Malta.
